1. Operator and scope
SpeakToScore is operated by Lear Labs Private Limited, referred to in these Terms as "SpeakToScore," "we," "us," or "our." These Terms apply to the SpeakToScore website, accounts, practice sessions, reports, Scout, Coach Mode, billing features, and related services.
Our Privacy Policy explains how we handle personal information, and our Refund and Cancellation Policy explains our voluntary refund rules and statutory consumer rights.
2. Acceptance and eligibility
By using the service, you confirm that you can enter into a binding contract under the laws that apply to you. You must be at least 13 years old. If you are under the age of legal majority where you live, a parent or legal guardian must review and accept these Terms for you and supervise your use of the service.
Do not use SpeakToScore if you do not agree to these Terms. Mandatory rights provided by consumer law in your country continue to apply and are not limited by these Terms.
3. Accounts and account security
- You must provide accurate, current information and keep it updated.
- You are responsible for protecting your password and account access.
- Accounts are personal and may not be sold, rented, shared, or transferred.
- You must notify us promptly if you suspect unauthorized access or misuse.
You may close your account in Settings. Account deletion is subject to limited legal, security, fraud-prevention, backup, and financial-record retention described in the Privacy Policy.
4. What SpeakToScore provides
SpeakToScore offers exam-style Speaking, Writing, Reading, and Listening practice for IELTS, TOEFL, and the Duolingo English Test. Features may include prompt-and-record practice, real-time voice sessions, Coach Mode, mock exams, reports, drills, progress tracking, readiness estimates, and Scout recommendations.
Speaking and Writing may be evaluated with AI. Reading and Listening are generally marked against stored answer keys, with automated explanations where available. Some reports are generated asynchronously and may take time to complete or require a retry after a provider or network failure.
SpeakToScore is independent. It is not affiliated with, endorsed by, sponsored by, or approved by IELTS, TOEFL, DET, ETS, IDP, the British Council, Cambridge, or Duolingo. Exam names and trademarks identify the practice format only and belong to their respective owners.
5. AI feedback, scores, and recommendations
AI-generated scores, transcripts, rewrites, pronunciation observations, study plans, university comparisons, and Scout responses are estimates for practice. They can be incomplete, subjective, delayed, or wrong. They are not certified scores and must not be presented as official results.
You remain responsible for reviewing outputs and deciding how to use them. Do not rely on SpeakToScore as a substitute for an official examiner, teacher, admissions officer, immigration adviser, legal adviser, or other qualified professional. We do not guarantee a score increase, admission, visa, employment, or any other outcome.
6. Your recordings, answers, and other content
You retain ownership of content you submit, including voice recordings, transcripts, written answers, selected answers, messages, and support material. You confirm that you have the rights and permissions needed to submit that content.
You give us a worldwide, non-exclusive, royalty-free license to host, copy, transmit, format, analyze, and display your content only as reasonably needed to operate, secure, troubleshoot, support, and improve the service and to produce the outputs you request. This license ends when the content is deleted, except for de-identified or aggregated information and copies we must retain for legal, security, or backup purposes.
7. Free access, paid plans, and usage rules
The pricing page and checkout identify the price, currency, access period, included features, usage allowances, and whether a purchase is one-time or recurring. Those purchase-specific terms are part of these Terms. If checkout and general marketing copy conflict, the terms displayed at checkout control for that purchase.
Free allowances reset on the schedule shown in the product. Paid plans may include fixed allowances for Live AI sessions, Coach Mode, mocks, or AI reports. A feature described as "unlimited" is available for ordinary, personal student use during the plan period, subject to reasonable rate limits, technical capacity, security controls, and protections against automated, shared-account, bulk, or abusive use.
We may temporarily delay or restrict unusually high-cost or automated activity to protect service reliability. We will not treat ordinary individual exam preparation as abuse. Unused allowances do not roll over unless the plan expressly says they do.
8. Prices, payment, and automatic renewal
Prices may vary by country, currency, tax, and promotion. Stripe processes payments. You authorize Stripe and us to charge the payment method provided for the amount and billing schedule shown at checkout.
A one-time pass expires at the end of its stated access period and does not renew. Recurring plans renew automatically at the price and interval shown at checkout until canceled. We may change a recurring price for a future renewal by giving legally required advance notice. Taxes may be added where required.
Failed, reversed, disputed, or overdue payments may result in restricted or suspended access. Promotional codes cannot be exchanged for cash and may have separate eligibility, territory, expiry, and one-use rules.
9. Cancellation, expiry, and refunds
You can manage or cancel an active subscription through the Stripe billing portal in your account. Cancellation prevents future renewal charges; unless required by law or stated otherwise in the Refund and Cancellation Policy, access continues until the end of the paid period and cancellation does not refund a charge already processed.
Refund requests are governed by our Refund and Cancellation Policy. Nothing in these Terms removes a statutory cancellation, withdrawal, refund, or remedy that applicable law does not allow us to exclude.
10. Acceptable use
You must not:
- use the service unlawfully, fraudulently, deceptively, or to harm another person;
- upload material that infringes intellectual property, privacy, or other rights;
- share an account or evade plan, payment, identity, geographic, or security controls;
- scrape, crawl, bulk-download, resell, sublicense, or commercially exploit the service;
- reverse engineer, probe, disrupt, overload, or bypass security or technical controls;
- use bots or automation to generate reports, consume allowances, or imitate human practice;
- access or attempt to access another user's account, recordings, reports, or data;
- misrepresent a practice score as an official result or use the service to facilitate cheating.
11. SpeakToScore intellectual property
The service, software, design, branding, question organization, prompts, report formats, scoring workflows, and platform content are owned by or licensed to Lear Labs Private Limited and are protected by intellectual property laws. Third-party exam content and trademarks remain the property of their owners.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use SpeakToScore and download or use your generated reports for your own educational preparation. No other rights are granted.
Feedback and suggestions you voluntarily send us may be used without restriction or payment, provided we do not publicly identify you without permission.
12. Third-party services and links
SpeakToScore depends on third-party services for authentication, cloud hosting, storage, voice communication, speech processing, AI analysis, analytics, referrals, and payments. Their own terms may apply when you interact directly with them, such as Stripe Checkout. We are not responsible for third-party websites or services outside our control, but this does not limit responsibilities the law places on us for our processors.
13. Availability, maintenance, and feature changes
We work to keep the service available, but do not promise uninterrupted or error-free operation. Network conditions, microphone permissions, browser compatibility, AI providers, payment services, and scheduled or emergency maintenance can affect access.
We may add, change, or discontinue features for legal, safety, technical, or commercial reasons. If a change materially removes the core value of an active paid plan, we will provide a reasonable remedy where required by law.
14. Suspension and termination
We may restrict or suspend access when reasonably necessary to investigate fraud, security risk, non-payment, abusive usage, a serious or repeated breach of these Terms, or a legal requirement. Where appropriate, we will give notice and an opportunity to correct the issue.
We may terminate an account for a material breach, illegal conduct, or an unresolved threat to the service or other users. Provisions concerning payment obligations, intellectual property, disclaimers, liability, disputes, and lawful retention survive termination where their nature requires it.
15. Disclaimers
To the fullest extent permitted by law, SpeakToScore is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. We do not warrant that AI outputs, transcripts, scoring estimates, or recommendations will be complete or error-free.
These disclaimers do not exclude warranties or remedies that applicable consumer law does not permit us to exclude.
16. Limitation of liability
To the fullest extent permitted by law, neither Lear Labs Private Limited nor its directors, employees, contractors, or affiliates will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, opportunity, or data, arising from the service.
To the fullest extent permitted by law, our total aggregate liability arising from the service or these Terms will not exceed the greater of the amount you paid to SpeakToScore during the 12 months before the event giving rise to the claim or USD 100.
These limits do not apply to fraud, willful misconduct, liability for death or personal injury caused by negligence, or any liability or consumer remedy that cannot lawfully be limited. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
17. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-law rules. Subject to mandatory consumer rights in your place of residence, courts with jurisdiction over the registered office of Lear Labs Private Limited will have non-exclusive jurisdiction.
Before filing a claim, please contact us and describe the issue so both sides can try to resolve it informally. This does not prevent either party from seeking urgent court relief or using a regulator, consumer forum, or small-claims process available under applicable law.
18. General terms
If a provision is found unenforceable, it will be limited to the minimum extent needed and the remaining provisions will continue. A delay in enforcing a right is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, merger, acquisition, or sale of the service, subject to applicable law.
These Terms, the Privacy Policy, the Refund and Cancellation Policy, and the terms shown at checkout form the agreement between you and us regarding the service. Headings are for convenience only. Electronic notices and records satisfy written-notice requirements where permitted by law.
19. Changes and contact
We may update these Terms as the service or law changes. We will update the effective date and, for material changes, provide additional notice where required. Changes do not retroactively remove rights already accrued. Continuing to use the service after revised Terms take effect means you accept the revised Terms.
Questions about these Terms can be sent to Lear Labs Private Limited at speaktoscore@gmail.com.
